With reference to our conversation with you

yesterday, we beg to point out that it will be impossible to

bring this action, which is next in the list for hearing, on

for trial on the 4th prox., on which date we understand from

the Chief Justice's recent notice, he will proosed to sit in

Original Jurisdiction.

Our counsel in the case are Mr. Potter and Mr.

Jenkin, both of whom are engaged in the action which has been

prooeeding before Mr. Justice Gompertz since December last, and

neither of whom have had any opportunity to begin to get up this

case. As you are aware, Mr. Potte” is appearing in the action

now before the Court for Messrs. Wilkinson & Grist's olient, and

Mr. Jonim for the Official Receiver. It will therefore be

impossible for this case to be heard till at least one of our

Counsel is available and even should the present proceedings before

the Puisne Judge not continue, we should require a sufficient

interval to slapse for Counsel to get up the oase, which use you

are aware, is one of considerable complication, involving as

it has done, discovery of a vast number of booka.

Further, so far as the “efendant's discovery is

concerned, it was not completed until a matter of some month

ago and that only after repeated applications to the Chief

Justice on our part extending over a period of more than eight

months.
